Joel - also see generally, e.g. N.C. Gen. Stat. 1A-1, Rule 12(b)(6).

Patrick - Don't sweat it. Even great schools can crank out lousy graduates. I wouldn't hold it against anyone that a deadbeat graduated from their school. If that was the standard, then no one would pull for Tennessee -- after all, I graduated from there. EVERY school has a few bad apples, and (as I indicated) this isn't an Alabama thing, it's a crazy "rogue booster" thing. By the way, thanks for dropping by and taking the time to comment.

MoonDog - Are you sure you aren't a lawyer? Those are some highly technical legal terms you used there. I think you have the makings of an excellent "evidence manipulation specialist" (a/k/a lawyer).

Not being an attorney I'm learning a little more about process serving. Although I did realize you can be served anywhere as you pointed out.

The only thing I can think of with regard to serving him papers at the SEC Media Days was to save the firm money so they wouldn't have to pay an out-of-state process server.

If I'm not mistaken, that's an expenditure the client would eventually be billed for anyway, correct?

I guess what I'm trying to say is I'm glad I don't have them representing me.

In the end, I'll give Fulmer some free advice. I'd tell opposing counsel to:

A: Go fornicate himself.
B: Pursue whatever course of action you deem needed.
C: I'll be at the designated place, at the designated time, and I will defend myself vigorously.
D: Did I mention you can go fornicate yourself?

Love,

Like you fellas, I also am a lawyer. And I am ashamed to say that these fools went to my school. I can assure you that we don't teach these hijinx there, and all of our civil procedure profs are very upstanding and ethical people. Give some people free reign though and you see what happens. Fulmer is a high profile target, and they got all types of publicity from it. But it's just poor lawyering, plain and simple, regardless of whether the person involved is friend or foe (in this case, Fulmer is technically neither).

"So what?" Had a nice chuckle at that because I thought the same thing at the immediately before I read it.

But you forgot the cite to the so what rule. Revised:

So what? See Tenn. R. Civ. Proc. 12.02(6).
